When a person is killed in a serious car accident in Mississippi, there is no doubt that the loss of their life often, if not always, has major impacts on a number of other people. Indeed, often a person who is involved in a fatal car accident in Mississippi leaves behind them a number of people who are deeply impacted by the loss of their loved one, and even whole communities can mourn the loss of members that have become an integral part of community life. Fortunately, Mississippi personal injury laws recognize that certain family members may be seriously injured by the loss of a close loved one to a negligent car accident, and, accordingly, should be entitled to recover money compensation for those injuries and losses. These laws are called wrongful death laws. But what exactly are wrongful death laws in Mississippi and who can bring wrongful death actions in Mississippi court? To help Mississippi families who have lost close loved ones to the negligent actions of another driver, we answer those questions here.

Wrongful Death Actions Under the  Mississippi Code – MS Code § 11-7-13 (2023)

The Mississippi Code sets forth Mississippi’s personal injury and wrongful death laws. MS Code § 11-7-13 (2023) sets forth that when a person is killed in a fatal accident due to another person or party’s negligent actions, certain close members of their family that are still surviving may bring a wrongful death action in Mississippi court. However, not all family members of the deceased person are entitled to file a claim and have legal standing to do so. Importantly, the Mississippi Code specifies which family members have legal standing to bring a wrongful death claim for the loss of their loved one. Those family members are the deceased person’s surviving spouse, parents, children, siblings, and their personal representative, if any. Damages that are recoverable under Mississippi wrongful death claims may include medical expenses for the treatment of their loved one prior to their death, costs associated with their burial and funeral, lost earnings, pain and suffering, loss of companionship, emotional distress, and more. In order to determine whether you may be entitled to file a wrongful death claim in Mississippi, and to find out what compensation you may be entitled to, it is best to speak with an experienced Mississippi personal injury lawyer about your case.
